Step-by-Step Guide

1

Notify the lender immediately

Contact the auto loan lender to report the death. Provide a copy of the death certificate. Ask about grace periods and options to avoid repossession.

Warning: Missing payments during probate can result in vehicle repossession.

2

Determine payoff or assumption options

Ask the lender about the remaining balance, payoff amount, and whether a surviving spouse or heir can assume the loan. Federal law (Garn-St Germain Act) protects surviving spouses.

3

Maintain insurance coverage

Keep the vehicle insured — the lender requires it. A lapse in coverage can trigger force-placed insurance at much higher cost.

4

Continue or settle payments

Continue making loan payments from the estate or negotiate a settlement. If the vehicle will be sold, coordinate payoff with the sale.

5

Obtain title upon payoff

Once the loan is paid off, the lender will release the title. File the lien release with the DMV to obtain a clear title.
